A recent incident involving a writer being wrongfully arrested due to misidentification by Flock license plate tracking cameras has brought renewed scrutiny to the technology's accuracy and its implications for law enforcement.
The core of the issue stemmed from a partial license plate match. The vehicle in question had New Jersey plates reading '34 10 DTM,' but when entered into Flock's system, it was recorded as '34 DTM.' The AI system, designed to alert law enforcement on partial matches, flagged a Range Rover bearing this simplified plate data as potentially stolen, triggering police action.
This misinterpretation was exacerbated by the commonality of similar plate structures among vehicles from Jaguar Land Rover's media fleet. The system's inability to distinguish the full plate, including the '10' in the middle, meant that other JLR vehicles with the '34 ## DTM' format could also be erroneously flagged nationwide, as evidenced by four other similar vehicles being tracked in Minnesota that same week.
Flock Safety's response initially defended its system, with CEO Daniel Thomas explaining that the AI correctly identified the '34 DTM' characters it was fed. He clarified that the system is configured to alert law enforcement when any part of a "hot list" plate is detected, a feature reportedly requested by law enforcement agencies who often work with incomplete initial data. Thomas emphasized that officers are trained to verify discrepancies, such as comparing a flagged '34 DTM' with an observed '34 10 DTM.'
However, the company has since faced criticism not only for the misidentification incident but also for past remarks by its CEO, who reportedly called privacy advocates "terrorists." Flock's CEO has since apologized for these comments, signaling a shift in public relations strategy amidst the growing controversy.
Further compounding privacy concerns, reports indicate that police departments are utilizing Flock's camera network for more than just vehicle tracking. Data reviewed by 404 Media suggests that law enforcement has used the system hundreds of times to search for individuals based on descriptive criteria, such as "heavy-set male with a black and white hat" or "person on skateboard." Some searches have even included race or political affiliation, raising significant questions about the scope of surveillance and potential for abuse.
The incident underscores a broader debate surrounding the deployment of automated license plate readers (ALPRs) and AI-driven surveillance technologies. While proponents argue these tools enhance public safety and aid investigations, critics point to risks of misidentification, over-surveillance, and the erosion of civil liberties.
